WORK PERMIT – ESSENTIAL LEGAL DOCUMENT FOR FOREIGN WORKERS IN VIETNAM

A work permit is a mandatory legal document for foreign nationals who wish to work legally in Vietnam. 1. Work Permit Application Documents

1.1 Documents from the Employer:

  • Business Registration Certificate
  • Additional Licenses (if applicable)
  • Approval for employing foreign workers
  • Application form for new issuance, extension, or reissuance of the work permit for foreign employees

1.2 Documents from the Employee:

  • Health certificate issued by an authorized medical institution in Vietnam or abroad, valid within 12 months from the issuance date to the submission date
  • Criminal record certificate or an official document confirming that the foreign employee is not currently serving a sentence, has no prior convictions, and is not under criminal investigation in Vietnam or their home country. This document must be issued within 6 months before the submission date
  • Proof of professional qualifications such as documents verifying managerial, executive, expert, or technical labor positions
  • Two (2) passport-sized photos (4cm x 6cm, white background, front-facing, no hat, no colored glasses), taken within the last 6 months
  • Certified copy of passport or a notarized copy verified by the employer, valid according to Vietnamese law

2. Eligibility Requirements for Work Permit Based on Job Position

2.1 Expert Position

  • University degree or equivalent
  • Work experience verification: Minimum of 3 years of experience in a relevant field that aligns with the position in Vietnam
  • Note: For intra-company transfers, additional documents such as an Appointment Decision and Work Experience Certification confirming at least 12 months of continuous employment at the parent company are required

2.2 Managerial or Executive Position

  • Official documents confirming the applicant as a manager or executive
  • Note: For intra-company transfers, an Appointment Decision and Work Experience Certification confirming at least 12 months of continuous employment at the parent company are required

2.3 Technical Labor Position

  • Certification of at least 1 year of training in a technical field or relevant industry
  • Minimum of 5 years of work experience in the related field
  • Note: For intra-company transfers, an Appointment Decision and Work Experience Certification confirming at least 12 months of continuous employment at the parent company are required

3. Who Needs a Work Permit?

Foreigners working in Vietnam under the following categories:

✔ Intra-company transfer
✔ Engagement in contracts or agreements related to economics, trade, finance, banking, insurance, science, technology, culture, sports, education, vocational training, and healthcare
✔ Service providers under contract

✔ Working for non-governmental organizations or international institutions legally operating in Vietnam
✔ Volunteers
✔ Representatives responsible for establishing commercial presence in Vietnam
